Illinois man convicted - again - for killing the man who answered Craigslist ad for sex with his pregnant wife

An Illinois man was sentenced for the first-degree kill – again – for giving dead a man who professedly went to his home to pay for sex with his then-pregnant spouse. 

Timothy Smith, 34, was indicted Thursday for the murder of Kurt Milliman, who was shot and killed in 2011 in the wake of noting a Craigslist promotion Timothy had set offering paid sex with his better half, Kimberly. 

It's his second conviction of a similar charge for the situation following a retrial, the Chicago Tribune announced. 

Judge Sharon Prather decided Thursday that Smith's cases that he lethally shot Milliman unintentionally, or, on the other hand, with regards to himself and his better half were not sound.

In the retrial, Prather said there was no evidence that Milliman displayed "a risk or peril that required the power connected" and noticed that Smith at first lied amid a 911 call and to police, guaranteeing the man was a home interloper. 

On Thursday, Prather dismissed less genuine decisions of second-degree crime or automatic murder when she declared the new conviction. 

Smith will be resentenced one month from now. He was at first allowed a 50-year jail term. 

Timothy and Kimberly Smith have since separated.
